Terms & Conditions

This document outlines the general framework for the services offered by Elite Football Agency. These T&Cs act as a guideline, explaining the rights and responsibilities of both parties. However, a final, individualized contract will be signed between the Agency and the player, which will fully detail all obligations, payments, and terms. This contract can be tailored to meet the specific needs and circumstances of the player, and only the signed contract will be legally binding.

§ 1 Subject of the Agreement

The primary purpose of the Elite Football Agency is to assist players in securing professional football contracts in Luxembourg. The Agency provides services that are specifically designed to support players in various aspects of their professional journey. These services include assistance with salary negotiations, arranging suitable accommodations, professional football training sessions, language courses for better communication, and facilitating introductions to professional football clubs. The ultimate goal is to provide players with the tools and support they need to succeed in European football.
 

§ 2 Application Process and Contract Conclusion

Players interested in the Agency’s services begin the process by selecting one of the available service packages: Basic Membership, Pro Membership, Trial, or Premium Trial. The application process allows both the player and the Agency the flexibility to withdraw from consideration at any time before a formal contract is signed. Importantly, an agreement is only finalized when both parties sign an individualized contract that outlines all terms in detail. Until this contract is signed, neither party is bound to any commitments or enforceable rights, even if the application is preliminarily accepted.
 

§ 3 Scope of Services

The Agency’s services are organized into distinct packages to suit different player needs. The Basic Membership provides foundational support, including management services, accommodation, and placement with a host club for one year. The Pro Membership builds upon the Basic package by adding weekly individual football and fitness training sessions to further develop the player’s skills. The Trial packages, which include both standard and premium options, offer players a short-term opportunity to experience professional training and assess their fit for a potential long-term commitment. These packages include accommodations, professional coaching, and, for the premium option, participation in test matches. The services and costs of each package are clearly outlined in their descriptions.
 

§ 4 Payment and Refunds

Payments for the Basic and Pro Membership packages are structured to provide flexibility. Players may choose to pay the full amount as a single installment or divide the payment into two equal semi-annual installments. In contrast, the Trial and Premium Trial packages require a single, non-divisible payment. Once payment is made and the contract is signed, the agreement is considered binding, and no withdrawal is possible. This policy ensures that services can be planned and delivered effectively without disruptions. Refunds are generally not available, except in cases where the Agency demonstrably fails to provide the agreed-upon services.
 

§ 5 Player Obligations

Players are expected to take personal responsibility for several important aspects of their professional preparation. This includes independently arranging for their studies, securing necessary insurance coverage (such as health and accident insurance), and actively participating in all scheduled training sessions, evaluations, and other activities organized by the Agency. As an additional option, players may request support from the Agency for arranging studies or insurance. These services are offered at an additional cost and are not included in the base packages. The player’s active engagement and cooperation are essential for achieving the desired professional outcomes.
 

§ 6 Agency Liability

The Agency’s liability is limited to delivering the services explicitly outlined in the player’s selected package. While the Agency aims to provide comprehensive support, it cannot guarantee the successful conclusion of a professional football contract. Additionally, the Agency is not liable for unforeseen circumstances, such as injuries, illnesses, or other events beyond its control, that may impact the player’s progress.
 

§ 7 Termination

Contracts with the Agency terminate automatically upon the fulfillment of the services specified in the chosen package. Early termination is permitted only in cases of significant breach of contract by either party. Both parties are expected to adhere to the terms agreed upon to ensure a smooth professional relationship.
 

§ 8 Data Protection

The Agency is committed to protecting the personal data of players. Any personal information provided will be used solely for the purposes of fulfilling the agreement and in compliance with applicable data protection laws. This includes ensuring that data is handled securely and not disclosed without proper authorization.
 

§ 9 Final Provisions

All amendments or additions to the contract must be made in writing to be valid. This ensures clarity and mutual agreement on any changes. The place of jurisdiction for any disputes arising from the agreement is Cologne, Germany, reflecting the Agency’s legal and operational base.
